Well, the easiest answer comes from ASCAP themselves: Aren't musicians, entertainers and DJ's responsible for obtaining permission for music they perform? Some people mistakenly assume that musicians and entertainers must obtain licenses to perform copyrighted music or that businesses where music is performed can shift their responsibility to musicians or entertainers. The law says all who participate in, or are responsible for, performances of music are legally responsible. Since it is the business owner who obtains the ultimate benefit from the performance, it is the business owner who obtains the license. Music license fees are one of the many costs of doing business. It is typically the festival's responsibility to buy an umbrella license for the event for all music performed at the festival. It is the responsibility of the musician to make sure this has been done. And some places you play may already have it and you're not even aware of it. In 30 years of performing I've never had an issue with this. So I wouldn't worry. That said, I do stay away from any Disney music because they are the most likely to hunt you down. :) -- Hurricane -
Ahoy all! Just got word. The festival is expanding. The Pirate Village, Thieves’ Market & Pirate Pub at Truman Waterfront is tentatively a go, just waiting for permits. If you know of any vendors who fall outside the guidelines for being in the fort this year, they can now be over at the Truman Annex waterfront. More food and more vendors - just have to be decorated piratical and have the sellers in pirate attire (not period correct). The Tryal of Anne Bonny and Mary Read will be over there this year on the new stage, the Walk the Plank Championships will be aboard the WOLF dockside and the Annex location will also host the Tall Tales contests, a pirate pub and more. The move will allow us to have a lot of the activities that were in town closer to the fort, creating more synergy for the event while offering more space for vendors, the stage and other piratical fun. Well, it's not the Caribbean but taking a press gang to Oregon to do a pirate dinner show for a casino up there. Getting paid to fly across the country with my closest friends, write a three act play and perform it and then hang around the next day and play with the general public. I'm good with that these days. Very blessed. Although I have to laugh that when I lived in Seattle they flew me to the Caribbean to do this and not that I'm in Florida they're flying us back the other way. -- Hurricane

Well said Mission. I do know that the new leadership was concerned about just being a bunch of partiers and out of control "pirates." Last year, they saw that was definitely not the case. In fact, I think they saw enough promise that they wanted to move everything inside so it had critical mass, much like their Civil War re-enactment. If they had seen anything at all that they didn't like or see promise in, I think we could guarantee we wouldn't be there again this year, as last year was the probationary period post Harry. -- Hurricane

I guess it's how you look at it. I've never thought of the Pyrate Fest and certainly not PiP as a place for strict re-enactment or for having the fort love us. It's the closest we can all come to a hippy-pirate event where all are welcome, from the polyester pirate to the hard core re-enactor. I don't think any of us does this for the fort - we do it for ourselves. It's the place to come where the weather is warm and the people are welcoming. It's just so Key West. It's nice that the fort lets people camp there for free. Key West is expensive to stay in otherwise. It's definitely the nicest campground I've ever been to in Florida. Can't bring cannons easily to the other ones and if a little demo keeps it free and available, terrific! I doubt anyone here who's been really feels slighted. Before 2005 there was no camping anywhere on the fort grounds. Then Harry let some then all out on the beach. And when Harry left, all the rules changed. That's what happens where there's a management change. But it still can't detract from the fact that Key West is one heckuva place to have a pirate festival and the campground is a bonus round, regardless where it is or what has to be done, because it allows more people to attend. Sure beats the days when we were all spread out in hotels across this 2 by 5 mile stretch of sand. -- Hurricane
